
This visa allows you to employ a skilled person for a contracted period of 3 months to 4 years. The applicant is classed as a temporary resident and you as the employer are responsible for their welfare. This includes an above award rate salary, superannuation, medical cover, and responsibility for any Commonwealth debt incurred by the employee.
The employee has to have qualifications equivalent to an Australian Certificate III or Diploma and the occupation must be on the Australian Standard Occupations Code (ASCO) list Levels 1-4 unless in a regional area where lower levels of skill can be utilized. They must also have the prescribed level of English language ability unless waivers apply.
This visa has undergone many changes of legislation in the past 12 months and employers must be made aware of the sanctions they face if they do not adhere to the migration law pertaining to this visa class. The sponsors and applicants are monitored by DIAC. Some Business Long Stay applications are also required to go through this process and then to the office of the Minister for Small Business before being submitted to DIAC.
