INTRO TO VISA
Regionally based employers are able to address identified labour shortages within their region by sponsoring skilled workers where employers can’t source Australian workers who are skilled.
ABOUT THIS VISA
This visa comprises 2 pathways:
1. Employer Sponsored Pathway
The employer is required to become a Standard Business Sponsor. The applicant is sponsored to work for the employer on this visa for 5 years. The occupation is required to be on the Regional Occupation List (ROL). The applicant must be paid a salary of at least TSMIT ($53900) and must be certified by the Regional Certification Board to be market related. The employer is required to provide employment for a period of 5 years with a pathway to Permanent Residence being available to the applicant after 3 years of living in the regional area and working in the occupation for three years. The pathway is through the Subclass 191 visa.
2. Labour Agreement Pathway
This stream is for skilled workers nominated by employers who have a labour agreement. Labour agreements are developed between the Australian Government (represented by the Department) and employers. The employment must abide by the provisions of the Labour Agreement and permanent residence is available to the applicant after having held the visa for 3 years, lived regionally for 3 years and worked in their occupation for 3 years. Labour agreements may also provide for additional concessions on language and age and experience and will be specific to that labour agreement and employees employed under that agreement.
The applicant is entitled to add family to this visa application and all applicants are required to meet heath, character and English requirements.
The pathway to permanent residence will be through the Subclass 191 visa.
After grant of the visa, the applicant is required to live and work regionally for the period that they hold the visa. They are required to work and live in the regional area for three years before they can access the Permanent Residence pathway. The applicant is entitled to Medicare benefits while on this visa.
