INTRO TO VISA

This visa subclass is a Permanent Residence partner visa.  It is the pathway for holders of the Provisional Partner Visa as well as applicants who have been in long term relationships and wish to formalise their visa status in Australia.

Health and character requirements must be met as well as proof that the relationship is continuous and ongoing.

ABOUT THIS VISA

The applicant is required to lodge evidence with the Department of Home Affairs, 2 years after the application of the Subclass 820 to show that the relationship is still ongoing, that the relationship remains committed and that the applicant and sponsor are continuing to live together.

This visa is the permanent residence portion of the onshore partner visa.  Lodgement of this subclass is online. The applicant must show that both they and the sponsor have maintained good character.

Evidence of financial commitment and living arrangements are required to show that the couple live together in a committed relationship. Evidence is required for any separation during the previous 2 years and an explanation for this separation is required.

The Immigration lodgement cost of this visa was covered when lodging the Subclass 820 and no Immigration lodgement fee is required to be paid on lodgement of the Subclass 801.

AFTER GRANT

The applicant can lodge this application onshore.  Grant will be onshore so if the applicant is offshore, they will be required to enter Australia on a different visa to have the visa granted.

Once granted, the applicant is a Permanent Resident of Australia and will be entitled to work, live and study in Australia. The visa is a pathway to citizenship.
