461 Partner Visa

INTRO TO VISA

The subclass 461 visa is an onshore or offshore Temporary residence partner visa. The 461 visa is only a temporary visa that does not have a direct pathway to permanent residence but does have work rights.

ABOUT THIS VISA

A Subclass 461 visa application can be lodged only if you qualify with the following:

• You must be in a married or de-facto relationship with a New Zealand citizen
• You and your Sponsor must be 18 years of age or older
• You must be in a genuine relationship and be able to prove it
• You can be in or out of Australia when you apply for this Visa
• If the visa was lodged in Australia, you must be in Australia at time of grant.
• If the visa was lodged outside Australia, you must be outside of Australia at time of grant.
• If you have held 461 you can apply for another 461 after 5 years.

AFTER GRANT

Once Granted this is a 5-year temporary visa. The applicant has no restrictions to work, live and study in Australia.
