INTRO TO VISA
The subclass 461 visa is an onshore or offshore Temporary residence partner visa. The 461 visa is only a temporary visa that does not have a direct pathway to permanent residence but does have work rights.
ABOUT THIS VISA
A Subclass 461 visa application can be lodged only if you qualify with the following:
- You must be in a married or de-facto relationship with a New Zealand citizen
- You and your Sponsor must be 18 years of age or older
- You must be in a genuine relationship and be able to prove it
- You can be in or out of Australia when you apply for this Visa
- If the visa was lodged in Australia, you must be in Australia at time of grant.
- If the visa was lodged outside Australia, you must be outside of Australia at time of grant.
- If you have held 461 you can apply for another 461 after 5 years.
AFTER GRANT
Once Granted this is a 5-year temporary visa. The applicant has no restrictions to work, live and study in Australia.
