INTRO TO VISA

This permanent residence visa is available to Australian Employers who wish to nominate skilled and qualified workers into highly skilled positions within the company. There are specific and relevant skills and experience criteria that must be met to qualify for this visa subclass

ABOUT THIS VISA

This visa comprises 3 Stream:

1. Direct Entry Stream

The employer is required to nominate the applicant into the position and show that the business requires the position and is unable to place a suitably qualified and experienced Australia Citizen or Permanent resident in this position. The Employer must show that the position is available for at least 2 years from the date of the visa grant and that the salary for the position will be at least TSMIT and will be market related. The applicant must show that they hold a valid Skills Assessment for the occupation, that the occupation is on the Medium Long Term Skills Occupation List (MLTSOL) and have the requisite English. The applicant must also show that they have at least 3 years of full time post qualification working experience. The applicant must meet heath and character requirements. The applicant can add in dependent family members who must also meet heath, character and English requirements.

2. Temporary Resident Transitional Stream

The applicant is required to hold either a Subclass 457 visa or a Subclass 482 visa with an occupation on the MLTSOL list and must have met the work requirement to be nominated by the employer into this stream. The employer is still required to show that the business requires the position and is unable to place a suitably qualified and experienced Australia Citizen or Permanent resident in this position. The Employer must show that the position is available for at least 2 years from the date of grant and that the salary for the position will be at least TSMIT and will be market related. The applicant is not required to show a valid skills assessment or work experience, but must meet the English Requirements as well as heath and character requirements. The applicant can add in dependent family members who must also meet heath, character and English requirements.

3. Labour Agreement Stream

This stream is for skilled workers nominated by employers who have a labour agreement. Labour agreements are developed between the Australian Government (represented by the Department) and employers. The employment must abide by the provisions of the Labour Agreement and the applicant must meet the requirements of the Labour Agreement for migration purposes. The applicant must meet heath and character requirements and any skill and English requirements that are set out in the Labour Agreement.

If the labour Agreement allows, the applicant can add in dependent family members who must also meet heath, character and English requirements.

AFTER GRANT

This is a Permanent residence visa which allows the visa holder to live work and study in Australia. The visa holder is entitled to travel in and out of Australia for an unlimited number of times in the first 5 years of the visa and thereafter they will require a Resident Return Visa to enter or exit Australia. The visa holder is entitled to Medicare and Centrelink benefits and this visa is a pathway to citizenship.
