INTRO TO VISA

The subclass 309 visa is an Offshore visa for partners and spouses of Australian Citizens, Permanent Resident and eligible New Zealand Citizens. The 309 visa is only a temporary visa but is the pathway for holders to gain their Permanent Visa subclass 100

ABOUT THIS VISA

You will need to firstly lodge a combined 309/100 visa application, but can only do so if you qualify with the following:

  • You must be in a married or de-facto relationship with an Australian citizen or permanent resident, or an eligible New Zealand citizen
  • You and your Sponsor must be 18 years of age or older
  • You must be in a genuine relationship and to be able to prove it
  • You must be outside Australia when you apply for this Visa
  • You must be offshore at Time of grant
  • You must travel to Australia in a specified time
  • Two years after lodging the initial 309 visa, you must be able to provide to immigration further evidence of your ongoing relationship in order to obtain permanent residency (100)
AFTER GRANT

Once granted, the applicant can enter Australia but will only be a temporary resident, but has no restrictions to work, live and study in Australia
